General Terms and Conditions (AGB)

1 Scope of application
1.1 These General Terms and Conditions (hereinafter "GTC") apply to all contracts, deliveries and services concluded between Altmetallhandel & Trockenbau GmbH (hereinafter "Supplier") and its customers (hereinafter "Customer").
1.2 Deviating, conflicting or supplementary terms and conditions of the Customer shall not become part of the contract unless the Supplier expressly agrees to their validity in writing.

2 Conclusion of contract
2.1 The presentation of services and products on the website does not constitute a legally binding offer, but a non-binding invitation to submit an inquiry.
2.2 A contract is concluded when the customer submits an inquiry and the provider confirms this in writing, by e-mail or by telephone.

3. services of the provider
3.1. the provider offers services in the area of scrap metal trade and drywall construction. The exact service details shall be agreed individually and set out in the contract or offer.
3.2. The Provider reserves the right to subcontract to third parties if this is necessary for the proper provision of services.

4. prices and terms of payment
4.1. all prices quoted are in euros and include VAT unless expressly stated otherwise.
4.2. unless otherwise agreed, invoices are due immediately upon receipt without deduction.
4.3. if the customer is in default of payment, the provider reserves the right to charge interest on arrears at the statutory rate.

5 Withdrawal and cancellation
5.1 The customer may withdraw from the contract if the provision of services has not yet begun. Any costs or expenses already incurred may be invoiced by the Provider.
5.2. The Provider reserves the right to withdraw from the contract if unforeseen circumstances make it impossible to fulfill the contract (e.g. force majeure).

6. liability and warranty
6.1. the provider is only liable for damages caused by intent or gross negligence.
6.2. the provider assumes no liability for damages caused by improper use or the customer's own fault.
6.3. the warranty period is 12 months, unless a longer period is prescribed by law.

7. data protection
The processing of the customer's personal data is carried out in accordance with the General Data Protection Regulation (GDPR). For further information, please refer to our privacy policy, which is available on the website at www.altmetallhandel-trockenbau.at/datenschutzerklaerung

8. final provisions
8.1. austrian law applies to the exclusion of the UN Convention on Contracts for the International Sale of Goods.
8.2. the place of jurisdiction for all disputes arising from this contractual relationship is the competent court at the registered office of the provider.
8.3. should individual provisions of these GTC be or become invalid, the validity of the remaining provisions shall remain unaffected.
